The US Ninth Circuit Court of Appeals has vacated a $9 million trademark infringement ruling in favor of Yuga Labs, creator of the Bored APE Yacht Club NFT collection. Artists Ryder Ripps and Jeremy Cahen successfully challenged the verdict, with the court finding insufficient evidence of consumer confusion between their derivative works and Yuga's original NFTs.

While the case remands to federal court for trial, the appellate decision establishes a landmark precedent: NFTs now explicitly qualify for trademark protection under US law. This clarification provides much-needed legal scaffolding for digital asset creators navigating intellectual property rights in Web3.
